§ 1. General provisions and provider details

These Terms set out how the website at budujpc.pl (the "Site") may be used, and the scope of the services provided electronically, in accordance with the Polish Act of 18 July 2002 on the provision of services by electronic means.

The Site is owned and operated by:
Tomasz Synowski, trading as FTC Tomasz Synowski, of ul. Agrestowa 12, 58‑100 Świdnica, Poland, registered in the Polish Central Registration and Information on Business (CEIDG), Polish tax identification number (NIP) 8842614103, statistical number (REGON) 022521207 (the "Provider", "we", "us").

You can reach us at kontakt@budujpc.pl, or by post at the address in paragraph 2. The address kontakt@budujpc.pl also serves as our single point of contact within the meaning of Articles 11 and 12 of Regulation (EU) 2022/2065 of the European Parliament and of the Council (the Digital Services Act) — for the authorities of Member States, the Commission and the European Board for Digital Services, and for recipients of the service alike. We can correspond in Polish or English.

Using the Site means accepting these Terms. They are made available free of charge at
/terms, in a form that allows you to retrieve, reproduce and store them.
§ 2. Definitions
- User ("you") — a natural person, legal person or organizational unit using the Site.
- Consumer — a User who is a consumer within the meaning of Article 22¹ of the Polish Civil Code and, to the extent the law provides, a sole trader who benefits from consumer protections under Article 385⁵ of the Polish Civil Code. The latter is a Polish law category covering an individual entrepreneur entering a contract that is not of a professional nature for them; where it applies, that person is treated as a Consumer under these Terms.
- Account — the set of resources and settings assigned to you once you register.
- External Shop — a business independent of the Provider that sells products and to which the Site links, including through affiliate links.
- Configurator — the Site's automated tool that selects and recommends sets of PC components.
- Content — the product information, technical specifications, prices and availability presented on the Site.
§ 3. Services provided electronically

Through the Site we provide the following services, all free of charge: a) access to the Configurator and to automated recommendations of PC builds; b) presentation of product information, specifications, prices and availability obtained from external sources; c) links to External Shops, including affiliate links; d) an Account, and the ability to save and share your configurations.

Some features, saving a configuration in particular, require you to register an Account.
§ 4. What this Site is — a key point

The Site is purely informational and comparative. We provide tools and information that make it easier to choose and compare PC components and offers.

We are not a seller of the products shown. We do not offer them for sale, do not sell them, do not take orders, do not collect payment and do not deliver anything.

We are not a party to any sales contract, or any other contract, between you and an External Shop. Any such contract is concluded solely between you and that External Shop, on its terms and under its own regulations. The External Shop alone sets the price, availability, delivery and payment terms, guarantee, statutory warranty of conformity, complaints procedure and right of withdrawal.

The information presented on the Site does not constitute an offer within the meaning of Article 66 of the Polish Civil Code. It is an invitation to review the offers of External Shops.
§ 5. Technical requirements

To use the Site you need a device with internet access, a current web browser with JavaScript and cookies enabled, and an active email account if you wish to register an Account.

We are not responsible for technical problems, or limitations of your own hardware or software, that prevent or hinder your use of the Site.
§ 6. Registration and Account

You register an Account by giving an email address, setting a password, and accepting these Terms and the Privacy Policy. We may require you to verify your email address.

You undertake to provide accurate details, to keep your password confidential, and not to share your Account with anyone else.

Accounts may only be used by people aged 16 or over. The Site is not directed at anyone under 16. By registering, you confirm that you are at least 16 years old.

You may delete your Account at any time and without giving a reason, either by contacting us or through the relevant function in your user panel. Deleting your Account terminates the contract for the Account service.

We may suspend or delete the Account of a User who breaches these Terms or the law, after first asking them to stop — unless immediate action is necessary for security reasons or because the law requires it.
§ 7. Rules of use

You must use the Site lawfully, in good faith and in accordance with these Terms.

The following are prohibited in particular: a) supplying unlawful content; b) any action that disrupts or destabilizes the Site, including excessive or automated load on our infrastructure; c) automated harvesting, copying or accumulation of Content or other material from the Site for further use without our consent; d) attempting to gain unauthorized access to the Site, to other Users' accounts, or to our infrastructure; e) using the Site in a way that infringes our rights or the rights of others.
§ 8. Prices and availability — important reservations

The prices, availability, descriptions and specifications shown on the Site come from external sources — from External Shops or third parties — and are informational and indicative only.

This data may be incomplete, out of date or wrong. It may in particular differ from reality because of update delays and changes made by External Shops.

Only the price, availability and terms shown by the External Shop itself, at the moment you place your order, are binding on you. We do not warrant that Content is current or correct, and we recommend that you check the offer directly with the External Shop before every purchase.
§ 9. The Configurator and recommendations — important reservations

The Configurator and its recommendations are automated and informational only. They are provided "as is", based on data from external sources and on the parameters you supply.

We do not warrant that recommended components are complete, correct, mutually compatible or fit for any particular purpose. A recommendation is not professional advice — technical, engineering or otherwise — nor an assurance within the meaning of the rules on the statutory warranty of conformity.

You must satisfy yourself as to the compatibility, specifications and suitability of components before buying, in particular by consulting the manufacturers and the External Shops. The decision to buy is yours, at your own risk and responsibility.

Main parameters governing selection and ranking. The Configurator selects and ranks components and builds according to the following main parameters: (a) the budget, intended use and optional component preferences you specify, such as a preferred component manufacturer; (b) the price of components and of the build as a whole; (c) component performance results, drawn both from publicly available benchmark data (Blender Open Data) and from the Provider's own gaming performance index, calculated from the technical specifications of the chips; (d) technical compatibility between components; and (e) availability at External Shops. Where your stated preferences would limit a build's performance, the Site may additionally propose a clearly marked alternative built solely on parameters (b) to (e); the choice between them is yours. Neither the presence of affiliate links nor the level of commission is a ranking parameter, and neither affects which recommendations are selected or the order in which they appear (see § 10(3)).
§ 10. Affiliate links

The Site contains affiliate links to External Shops. This means we may receive a commission on purchases made through them.

Using an affiliate link costs you nothing extra and does not change the price of the product at the External Shop.

We confirm that the presence of affiliate links does not influence how the recommendation algorithm works, or the neutrality of the results shown.

Links to the shop x-kom.pl are referral links under the SalesMasters programme, through which we work with x-kom sp. z o.o. Visits to other External Shops go through those shops' own partner programmes, via affiliate networks that record the click in order to settle commission.
§ 11. Intellectual property and trade marks

The Site, its layout, code, graphics and original content, and the "BudujPC" trade mark, are legally protected and belong to us or to the parties entitled to them. They may not be used without our consent.

The names, logos and trade marks of manufacturers and External Shops — component makers and shops, for instance — belong to their respective owners. We use those names for information and identification purposes only (nominative use). Such use does not imply any affiliation, partnership, sponsorship or endorsement by those parties unless we state otherwise.

We display an External Shop's logo only where the material has been supplied to us by the party entitled to it or by its affiliate network, and only on that party's terms — unaltered and without modification. Where we have no such basis for a shop's logo, we do not display it and use the shop's name instead.
§ 12. Liability

We provide our services with due care. Given that the Site is free of charge, informational, and acts as an intermediary, we exclude our liability to the fullest extent the law allows for: a) Content from external sources being out of date, incomplete or incorrect, including prices, availability and specifications; b) your purchasing decisions and their consequences, including the choice of components and any incompatibility between them; c) the acts, omissions, offers, order fulfilment, payments, delivery, guarantees, statutory warranty of conformity and complaint handling of External Shops; d) the content and policies of third‑party websites we link to; e) interruptions, restrictions or disruptions in the availability of the Site, including those caused by maintenance, force majeure or the actions of third parties.

Consumer protection clause. Paragraph 1 and any other provision of these Terms limiting our liability do not exclude or limit a Consumer's rights under mandatory provisions of law. In particular, nothing excludes liability for damage caused intentionally, for personal injury, or any liability that cannot lawfully be excluded as against a Consumer. Where any provision conflicts with mandatory consumer protection law, that law prevails.

Business users (B2B). As against Users who are not Consumers, our liability arising from the services provided on the Site is excluded to the fullest extent permitted by law. This includes the exclusion of liability for lost profits (lucrum cessans), and our total liability — where exclusion is not permitted — is limited to actual loss suffered (damnum emergens). These exclusions and limitations do not apply to damage we cause intentionally (Article 473(2) of the Polish Civil Code).
§ 13. Complaints about the Site

Complaints about how the Site works — as opposed to purchases made at External Shops — may be sent to kontakt@budujpc.pl, describing the problem and giving your contact details.

We will consider your complaint within 14 days of receiving it and will tell you the outcome at the email address you gave.

Complaints about products, orders, payments or deliveries should go directly to the External Shop concerned, as it is the party to the sales contract.
§ 14. Out‑of‑court dispute resolution

A Consumer may use out‑of‑court procedures for handling complaints and pursuing claims, including those before the regional inspectorates of the Polish Trade Inspection Authority (Inspekcja Handlowa) and the permanent consumer arbitration courts. Information is available from, among others, the Polish Office of Competition and Consumer Protection (Urząd Ochrony Konkurencji i Konsumentów) at uokik.gov.pl.

Using an out‑of‑court procedure is voluntary and requires both parties to agree.
§ 15. Withdrawal from the contract

The services on the Site are provided free of charge. A User who is a Consumer and has entered into a contract for services provided electronically — an Account, for example — may stop using the service and delete the Account at any time. Doing so terminates the contract with immediate effect and at no cost.

Because the services are free of charge, the rules on the obligation to pay under contracts for the supply of digital content or digital services do not apply to contracts concluded on the Site.
§ 16. Changes to these Terms

We may change these Terms for valid reasons, including changes in the law, changes to the scope or manner of the services, and security considerations.

Users with an Account will be told about a change by email and through publication of the updated version on the Site, at least 14 days before it takes effect. Continuing to use the Site once the change takes effect means accepting it. A User who does not accept the change may delete their Account before the effective date.
§ 17. Governing law and jurisdiction

Matters not covered by these Terms are governed by Polish law and by the applicable law of the European Union.

The choice of Polish law does not deprive a Consumer of the protection afforded by the mandatory provisions of the law of their country of habitual residence.

Disputes with a User who is not a Consumer will be settled by the court having jurisdiction over our registered office. Disputes involving a Consumer are heard by the court determined under generally applicable law.
§ 18. Final provisions

If any provision of these Terms is held invalid or ineffective, the remaining provisions stay in force (severability). The invalid provision is replaced by the applicable law and by the provision closest to its intended commercial purpose.
